Terms of Service

Last updated: October 14, 2026

The rules that govern access to DarwinFind and the use of public-source search results.

Important

DarwinFind is an informational research tool, not an investigative authority or decision-making service. You are solely responsible for having a lawful purpose, verifying every result and deciding whether or how to use it.

Key points

  • Publicly accessible sources only — no hacking, intrusion or bypassing access controls.
  • Results are automated leads, not verified facts, allegations or professional advice.
  • You must independently verify information and accept responsibility for every action you take.
  • Never use DarwinFind for employment, housing, credit, insurance or other regulated eligibility decisions.

1. Acceptance and scope

These Terms of Service govern your access to and use of the DarwinFind website, search tools, reports, subscriptions, communications and related features, collectively the Service. By accessing or using the Service, you confirm that you have read, understood and agreed to these Terms and our Privacy Policy.

If you use the Service for an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, do not use the Service.

2. Informational service only

DarwinFind organizes and summarizes information located in publicly accessible online sources. The Service provides research assistance and general reference information only. It does not conduct official background checks, establish identity, certify facts, determine truth, provide surveillance services or make recommendations about any person.

A result, similarity score, association, label, category or automated summary is a lead for further review — not proof that a person owns an account, engaged in conduct, has a particular characteristic or is connected to another person. The absence of a result is not proof that information does not exist.

The Service is not legal, financial, employment, credit, insurance, medical, safety, cybersecurity or other professional advice. You must consult a qualified professional where appropriate.

3. Public sources only — no unauthorized access

The Service is designed to retrieve, index, compare, summarize and link to material that was publicly accessible to ordinary internet users or publicly indexed at the time of collection. Typical sources may include public web pages, public profiles, public directories, public posts, news archives, search indexes and other openly available records.

DarwinFind does not intentionally access private accounts, private messages, password-protected pages, closed databases or non-public records. We do not hack systems, exploit vulnerabilities, steal credentials, decrypt protected data, impersonate another person, defeat authentication, or bypass privacy settings, paywalls, CAPTCHAs or technical access controls. We do not authorize users to do any of those things.

Where a report references a publicly documented data incident or exposure index, the reference is intended only to indicate that an identifier may have appeared in a known incident. DarwinFind does not provide passwords, authentication secrets or access to compromised accounts.

Public availability does not guarantee accuracy, lawfulness, relevance or permission for every downstream use. Your obligations under privacy, data-protection, anti-discrimination and other laws still apply.

4. Not a consumer reporting agency

DarwinFind is not a consumer reporting agency under the U.S. Fair Credit Reporting Act or any comparable law, and reports are not consumer reports. We do not verify information to the standards required for regulated screening.

  • Do not use the Service to determine eligibility for employment, promotion or discipline.
  • Do not use it for housing, tenancy, credit, lending, insurance or financial services.
  • Do not use it for education admission, licensing, government benefits or any legally regulated eligibility decision.
  • Do not use it to make an adverse decision based on a protected characteristic or sensitive personal information.

5. Eligibility and account responsibility

You must be at least 18 years old and legally capable of entering into a binding agreement. You must provide accurate account and billing information, maintain the security of your email and devices, and promptly notify us of suspected unauthorized access.

You are responsible for all searches, purchases and activity performed through your account, including activity by anyone to whom you provide access. Accounts and reports are personal, limited and non-transferable unless we expressly agree otherwise.

6. Your lawful purpose and responsibility

Before each search, you are solely responsible for determining that you have a legitimate, lawful and proportionate purpose and, where required, a valid legal basis, consent or other authorization. You are also solely responsible for the identifiers, images and context you submit, the people you search, your interpretation of results and every decision, message, publication or action arising from them.

You agree to independently verify material through authoritative sources before relying on it; consider the risk of namesakes, impersonation, satire, copied images, recycled usernames and stale records; comply with all applicable laws; and avoid conclusions that are not supported by reliable evidence.

7. Prohibited use

You may use the Service only for lawful, good-faith personal research. You must not use or attempt to use it to:

  • stalk, harass, threaten, intimidate, shame, blackmail, dox, discriminate against or physically locate a person who does not wish to be found;
  • commit or facilitate fraud, identity theft, account takeover, phishing, social engineering, extortion or any other unlawful act;
  • contact a person in a deceptive or abusive manner, publish sensitive data or encourage others to target them;
  • infer or exploit highly sensitive traits, including health, sexual life, precise location, religion or political views, where prohibited by law;
  • make any regulated or high-impact eligibility decision described above;
  • search for or process information about a minor except where you are the parent or legal guardian and the activity is lawful and necessary for the minor’s safety;
  • scrape, crawl, reverse engineer, overload, probe or circumvent the Service, rate limits, access controls or security measures;
  • resell, republish, redistribute or build a competing database from reports; or
  • infringe privacy, publicity, intellectual-property or other rights of any person.

8. Automated matching and accuracy limitations

Searches and reports may use automated retrieval, similarity analysis, ranking and language-model systems. These systems can misclassify, hallucinate, omit context, connect unrelated people or reproduce errors from source websites. Similar names, faces, locations, emails, telephone numbers and usernames do not establish identity by themselves.

Information may be incomplete, outdated, duplicated, altered, removed or falsely posted by third parties. Scores and confidence labels are estimates, not probabilities, guarantees or expert conclusions. We do not warrant that a report is complete, current, accurate, unique to the searched person or suitable for any purpose.

You assume the entire risk of relying on or acting upon any result. If a matter could affect rights, safety, reputation, finances or legal interests, verify it directly with the person and authoritative records before acting.

9. Third-party sources and links

Reports may link to websites and services we do not own or control. A link does not mean that DarwinFind endorses the source, its operators, its content or its data practices. Third parties may change, block, delete or restrict content at any time and may impose their own terms.

We are not responsible for third-party content, availability, security, legality, accuracy, conduct or privacy practices. Your use of a third-party site is at your own risk and subject to that site’s terms.

10. No affiliation or endorsement

DarwinFind is an independent service. Unless we expressly state otherwise, we are not affiliated with, sponsored by, endorsed by or acting on behalf of any person, organization, website, platform, data broker, security service or other source referenced in a search result or report.

Names, trademarks and source references are used only to identify the relevant third-party source or context. Their appearance does not imply a partnership, authorization, endorsement or verification of DarwinFind or its findings.

11. Subscriptions, billing and renewal

Prices, currency, included features, trial or promotional terms and billing intervals are shown before purchase. Unless checkout states otherwise, subscriptions renew automatically at the then-current price until canceled. You authorize the payment provider to charge the payment method on file for recurring fees and applicable taxes.

You must cancel before the renewal date to avoid the next charge. Cancellation stops future renewal and normally leaves access active until the end of the paid period. Deleting the app, closing a browser or ceasing use does not cancel a subscription. Refunds are governed by our Refund & Cancellation Policy and mandatory law.

We may change prices or plans prospectively by giving notice required by law. Payment processors and app stores may apply separate terms, exchange rates and processing rules.

12. Intellectual property and limited license

The Service, including its software, design, branding, text and original report presentation, belongs to DarwinFind or its licensors and is protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service and unlocked reports for your own lawful, non-commercial purposes.

Source material remains owned by its respective owner. You may not copy, modify, sell, license, publicly display, systematically extract or create derivative databases from the Service except where law expressly permits it.

13. Removal, correction and source disputes

A person identified in a report may request removal or suppression through our Remove My Data page. Removal from DarwinFind does not remove information from the original website, search engine, archive or public record. Requests to correct or remove source content must be directed to the source owner.

We may preserve limited records where reasonably necessary to honor suppression, prevent fraud, establish legal claims or comply with law.

14. Suspension and termination

We may limit, suspend or terminate access, remove content, refuse a search or cooperate with lawful authorities if we reasonably believe activity violates these Terms, threatens a person or the Service, creates legal risk, involves fraud or is required by law. Where permitted, abusive or prohibited use may result in termination without refund.

You may stop using the Service at any time. Provisions that by their nature should survive termination — including responsibility, intellectual property, disclaimers, liability limits and indemnification — will survive.

15. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL REPORTS ARE PROVIDED “AS IS,” “AS AVAILABLE” AND “WITH ALL FAULTS.” DARWINFIND DISCLAIMS ALL EXPRESS, IMPLIED AND STATUTORY WARRANTIES, INCLUDING ACCURACY, COMPLETENESS, CURRENCY, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will find any particular information, correctly identify any person, be uninterrupted, secure or error-free, or that defects will be corrected. No oral or written statement creates a warranty not expressly stated in these Terms.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DARWINFIND AND ITS AFFILIATES, OFFICERS, PERSONNEL, CONTRACTORS, LICENSORS AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITY; REPUTATIONAL HARM; PERSONAL DISPUTES; OR CLAIMS ARISING FROM THIRD-PARTY CONTENT, USER CONDUCT, MISIDENTIFICATION, INACCURATE OR MISSING RESULTS, OR YOUR RELIANCE ON OR USE OF THE SERVICE — EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE.

To the fullest extent permitted by law, our total aggregate liability arising from or relating to the Service will not exceed the greater of the amount you paid DarwinFind for the Service during the twelve months before the event giving rise to the claim or USD 100. The exclusions and cap apply to all theories of liability and even if a remedy fails of its essential purpose.

Some jurisdictions do not allow certain exclusions or limits. In that case, these provisions apply only to the maximum extent permitted. Nothing in these Terms excludes liability or mandatory consumer rights that cannot legally be excluded.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless DarwinFind and its affiliates, personnel and providers from claims, losses, liabilities, damages, judgments, costs and reasonable legal fees arising out of your searches, submitted content, violation of these Terms or law, infringement of another person’s rights, or use, disclosure, publication or interpretation of report information.

18. Service changes and availability

We may add, change, limit or discontinue features, sources, plans and availability at any time. Sources can become unavailable without notice. We may update these Terms prospectively; the updated date will appear above, and material changes will be communicated where required by law. Continued use after an update takes effect constitutes acceptance.

19. Governing rules and mandatory rights

These Terms are governed by the laws applicable to the DarwinFind operating entity, without regard to conflict-of-law principles. Any mandatory consumer-protection rights in your place of residence remain unaffected. Before beginning formal proceedings, please contact us and allow a reasonable opportunity to resolve the concern informally.
